Multiple DUI Offenses

The first time a person is convicted of driving under the influence, he or she will face a variety of legal penalties, such as probation, monetary fines, mandatory participation in an alcohol treatment program, community service, a mark on his/her permanent record, and sometimes even jail. However, the more DUI offenses a person accumulates on his/her record, the more severe the penalties will be.

When a driver is convicted multiple DUIs, there are set penalties he/she will be subjected to. Driving under the influence is a serious crime, and judges and prosecutors will see to it that you are punished for your actions. If you have been convicted of multiple DUI offenses, you could potentially face the following penalties:

1st DUI
  • Possible Jail Time: 0-6 months
  • Fines: Approx. $3,000
  • Probation: 1-5 years
  • Driver’s License Suspension: 4-6 months
  • Mandatory Rehabilitation/Alcohol Classes: 3-9 months
  • Car insurance will increase or be terminated

2nd DUI

  • Possible Jail Time: 90 days to one year
  • Fines: Approx. $3,000, plus some additional charges
  • Probation: 1-5 years
  • Driver’s License Suspension: up to 2 years
  • Mandatory Rehabilitation/Alcohol Classes: 18 months or a 30 day treatment program
  • Termination or substantial rise in car insurance costs

3rd DUI

  • Mandatory Jail Time: 120 days/ 4 months to one year
  • Fines: Approx. $3,000, plus some additional charges
  • Probation: 1-5 years
  • Driver’s License Suspension: up to 3 years
  • Mandatory Rehabilitation/Alcohol Classes: 18 months or a 30 day treatment program
  • Termination or substantial rise in car insurance costs

4th DUI

  • Mandatory Jail Time: 180 days/6 months to 3 years
  • Fines Approx. $3,000, plus some additional charges
  • Probation: 1-5 years
  • Driver’s License Suspension: up to 4 years
  • Mandatory Rehabilitation/Alcohol Classes: 18 months (if the defendant never completed one)
  • Termination or drastic rise in car insurance costs
  • DUI could be tried as felony offense, instead of a misdemeanor
