DMV Hearing
In California, it is illegal to operate or drive a car while under the influence of drugs or alcohol. If you are found driving under the influence, you will be arrested and charged with the criminal offense of DUI. At this time, your driver’s license will be confiscated and you will be issued a temporary driving permit that is good for 30 days.
Within TEN days of your arrest, it is essential to schedule a hearing with the California Department of Motor Vehicles. This hearing gives you and your attorney the opportunity to challenge your driver’s license suspension, and try to get your driving privileges reinstated. This also allows you to drive with a temporary license pending the outcome of your case. Failure to schedule a hearing within ten days waives your right to challenge your suspension. In addition, if you do not schedule a DMV hearing within 10 days, your driver’s license will be automatically suspended for up to four months.
At the hearing, your attorney has the opportunity to present evidence and testimony in your favor, and challenge any evidence brought against you.
